Commercial law
In cases concerning environmental protection or general safety, public interest requires that new companies be checked thoroughly prior to launch. Anyone who is planning a commercial business and is not certain whether it is subject to this licensing requirement, can contact the local economic development office or the local Chamber of Industry and Commerce (IHK).
Building project planning law
The building project planning law is governed by the federal building code (BauGB), the land use act (BauNVO) and zoning maps. Investors need to obtain the correct planning allocation for their location. In other words, the area must be classified as a commercial, industrial, core or special zone.
Building regulations
Building regulations are the responsibility of the states. The building regulations issued by North Rhine-Westphalia (BauONW) regulate a wide range of safety requirements, such as fire protection, and include numerous urban planning instructions for lot development, open spaces and more.
Environmental law
Environmental law is intertwined with building law; most construction projects must also simultaneously meet environmental regulations. The Federal Emission Control Act (BImSchG) provides a list stating which facilities require special authorization. Additional areas of environmental regulation are noise protection, waste legislation, water legislation, soil conservation law, nature conservation and, in particular, environmental impact analysis (UVPG).
