Trademarks and Patents

German patent and trademark law is essentially in line with international standards. Nevertheless, companies or individuals should seek a patent attorney for advice on whether a design patent (Gebrauchsmuster - minor patent) is a suitable alternative to a patent application. Both types of industrial property rights prohibit unauthorized imitation. However, the design patent is easier, quicker and cheaper to obtain. Trademarks serve to ensure unmistakable identification of goods and services. The German Patent and Trade Mark Office in Munich is responsible for registration of commercial property rights. This office also researches whether specific property rights are already in existence.

In addition to the German Patent and Trade Mark Office, Munich is also home to the European Patent Office (EPO).
Through the EPO, companies can register patents for one or all of the EPO contracting states. As of October 2003, contracting states include member states of the European Union (EU), Switzerland, Liechtenstein, in addition to many other European countries such as Turkey, Romania and Bulgaria.
